These Terms of Use ("Terms") govern your access to and use of www.aja-edu.com and any related services operated by Ajademy ("Ajademy," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of these Terms

Use of the Service constitutes your acceptance of these Terms and our Privacy Policy. If you are using the Service on behalf of an organization (e.g., a school), you represent that you have authority to bind that organization to these Terms.

2. The Service

Ajademy is a free search engine for educational resources serving Filipino learners. We index and surface resources covering DepEd K-12 content, TESDA vocational programs, foreign language learning, and Philippine board examination reviewers (PRC, CSC, and others). The Service is provided free of charge and includes both curated links to public official sources and resources contributed by approved contributors.

3. Contributor Accounts

Uploads are limited to invited contributors who have applied through our application form and been approved. As a contributor, you agree to:

• Provide accurate information in your application and maintain the confidentiality of your account credentials.
• Be responsible for all activity under your account.
• Notify us immediately at learn@aja-edu.com of any unauthorized access.
• Only upload material you have the right to share.

We reserve the right to refuse, suspend, or terminate any contributor account at our sole discretion, with or without notice, for any violation of these Terms.

4. Your Content and Licensing

You retain all ownership of any educational resource you upload ("Your Content"). By uploading, you grant Ajademy a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and distribute Your Content on the Service for the purpose of operating and promoting Ajademy. You may withdraw this license at any time by requesting removal of Your Content; we will remove the resource within a reasonable period from receipt of the request.

You represent and warrant that you have all rights necessary to grant the license above, and that Your Content does not infringe the intellectual property rights of any third party.

5. Copyright Policy under RA 8293

Ajademy respects the intellectual property rights of others and complies with the Intellectual Property Code of the Philippines (Republic Act No. 8293, as amended).

5.1 Educational fair use (Sec. 184)

Section 184 of RA 8293 enumerates limitations on copyright that permit certain uses without infringing the copyright owner's rights, including the use of a work as part of teaching, scholarship, research, and similar educational activities, provided the use is compatible with fair use and that the source and the name of the author are acknowledged.

Where Ajademy displays copyrighted materials of third parties, we do so in reliance on these limitations or with the permission of the rightsholder. We require contributors to upload only:

• Material they themselves authored;
• Material released into the public domain;
• Material under a permissive license (e.g., Creative Commons, with attribution as required); or
• Material for which they have obtained the necessary permissions from the rightsholder.

5.2 Notice and Takedown

If you believe in good faith that material on the Service infringes your copyright or related rights, you may submit a takedown notice to learn@aja-edu.com with the subject line "Copyright Notice." Your notice should contain:

1. Your full name, address, telephone number, and email address.
2. A description of the copyrighted work you claim has been infringed (or, for multiple works, a representative list).
3. The exact URL(s) on the Service where the allegedly infringing material is located.
4. A statement, made in good faith, that you believe the use of the material is not authorized by the rightsholder, its agent, or the law.
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rightsholder or authorized to act on the rightsholder's behalf.
6. Your physical or electronic signature.

5.3 Action upon notice

Upon receipt of a complete and good-faith notice, Ajademy will promptly remove or disable access to the material in question and notify the contributor who uploaded it. If you are the contributor and you believe the takedown was in error or that the material falls within an exception under RA 8293, you may submit a counter-notice to the same email containing the URL, your contact information, your basis for believing the takedown was improper, and a statement under penalty of perjury that the counter-notice is accurate.

5.4 Repeat infringers

It is our policy to suspend or terminate the accounts of contributors who, in our sole judgment, have repeatedly uploaded infringing material.

6. Prohibited Uses

You agree not to use the Service to:

• Upload, post, or distribute material that infringes the intellectual property rights of others;
• Distribute commercial answer keys, leaked examination papers, or material that compromises the integrity of any official examination;
• Upload malware, viruses, or content designed to disrupt the Service or any user's device;
• Misrepresent your identity, credentials, or affiliation;
• Harvest or scrape the Service for purposes beyond personal educational use;
• Use the Service to harass, defame, or harm any individual or group;
• Violate any applicable Philippine law, including but not limited to RA 10173 (Data Privacy Act), RA 8293 (Intellectual Property Code), and RA 10175 (Cybercrime Prevention Act).

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

While we strive to surface high-quality educational resources, Ajademy does not guarantee the accuracy, completeness, or alignment of any third-party material with the latest DepEd, TESDA, PRC, CSC, or CHED standards. Always verify critical content (especially for board examinations) against official sources before relying on it.

8. Limitation of Liability

To the fullest extent permitted by Philippine law, Ajademy and its operators, contributors, and processors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Service, including damages for loss of data, examination outcomes, or substitute services.

9. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of the City of Manila, Philippines, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may revise these Terms at any time. Material changes will be posted on this page with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
